Acceptable Use Policy — PreBookmt

This Acceptable Use Policy ("AUP") sets out what you may and may not do on PreBookmt (the "Service"). The AUP is incorporated into our Terms of Service (see Section A.4). Violating the AUP is a breach of the Terms of Service and may lead to suspension or termination of your account.
The AUP applies to all users — customers, business owners, staff members, and anyone who interacts with the Service.
1. Operator
The Service is operated by:

2. Prohibited content
You must not upload, post, message, list, or otherwise distribute through the Service any content that:
- Is unlawful under Maltese or EU law, including the Maltese Criminal Code, Consumer Affairs Act (Cap. 378), Equality Act, and Electronic Commerce Act (Cap. 426)
- Incites violence, terrorism, self-harm, or hatred
- Discriminates against any person on the basis of race, ethnic origin, gender, sexual orientation, gender identity, disability, age, religion, or belief
- Is defamatory, libellous, threatening, or harassing
- Infringes the intellectual property, privacy, publicity, or other right of any third party
- Contains malware, viruses, trojans, or other malicious code
- Is sexually explicit, depicts nudity, or sexualises children in any way
- Promotes or advertises sexual services, escort services, or adult-entertainment services
- Promotes illegal drugs, weapons, ammunition, counterfeit goods, or stolen property
- Promotes gambling, betting, or any service regulated by the Malta Gaming Authority without a licence
- Misrepresents your identity, qualifications, or business in a misleading way
- Contains personal data of any third party uploaded without that person's lawful basis
3. Prohibited services (business owners)
If you list a business on PreBookmt you confirm you are legally entitled to provide every service you list. You must not list:
- Unlicensed medical or healthcare services — including procedures that under Maltese law may only be performed by a registered medical practitioner, dentist, pharmacist, or other licensed professional
- Aesthetic or cosmetic procedures requiring a licence (e.g. injectables, laser treatments) — without holding the required licence
- Tattooing or piercing without health authority registration
- Beauty or hair services offered by individuals who do not hold any required Maltese vocational qualification or work-permit where applicable
- Adult, erotic, escort, or sexual services of any kind — these are out of scope for PreBookmt regardless of legality
- Animal-related services (grooming, boarding) without applicable Maltese animal-welfare authorisations
- Childcare services without the required licensing under the Maltese Education Act
- Services that exclude customers on a protected-characteristic basis (race, sex, sexual orientation, disability, religion etc.)
If you are uncertain whether a service can be lawfully offered through PreBookmt, email legal@prebookmt.com before listing.
4. Prohibited conduct — all users
You must not:
- Create more than one account for yourself (unless an additional account is required for a separate legitimate business you operate, and you tell us about it in advance)
- Share your account credentials with anyone other than members of your business who need access
- Impersonate another person, business, or member of PreBookmt staff
- Use the Service to send unsolicited commercial messages or recruitment messages outside the in-app messaging feature's intended use
- Use the Service to harvest, scrape, or extract data about other users, businesses, or staff
- Use any automated tool, bot, crawler, or scraper to access the Service, except for search-engine crawlers indexing public pages of
prebookmt.com - Reverse-engineer, decompile, or disassemble any part of the Service
- Interfere with the Service's normal operation, including by overloading endpoints, abusing rate limits, or sending malformed requests
- Attempt to bypass any security, rate-limit, paywall, or access control
- Use the Service to launder funds, evade tax, or commit any other financial crime
5. Prohibited conduct — customers
You must not:
- Post fake reviews — every review you post must be based on a real, completed booking that you personally experienced
- Coordinate reviews with other customers in exchange for compensation
- Repeatedly no-show to bookings — repeated no-shows may result in account suspension
- Harass, threaten, or abuse business owners, staff members, or other customers in messages, reviews, or any other interaction
- Use the Service to make a booking you know you cannot or will not honour
6. Prohibited conduct — business owners
You must not:
- Post fake or misleading information about your business, services, prices, staff qualifications, or location
- Solicit reviews you know to be fake or pay for reviews from anyone who did not receive the service
- Threaten, retaliate against, or harass customers who post a truthful negative review
- Use customer data obtained through PreBookmt for any purpose other than fulfilling the booking and providing the service — see the Data Processing Addendum for your obligations as Data Controller for your customers' data
- Send marketing messages to PreBookmt customers without their explicit consent obtained outside the platform
- Refuse a booking on a protected-characteristic basis (race, sex, sexual orientation, disability, etc.)
- Charge a customer a different price from the price displayed at the time of booking, except where the customer has explicitly agreed to changes (e.g. additional services performed)
- Move bookings off-platform during the platform's free trial in order to avoid subscribing
- Resell, sublicense, or white-label the PreBookmt platform to a third party
7. Anti-spam in messaging
The in-app messaging feature is intended for communication directly related to a booking, an enquiry about your business or service, or service follow-up. You must not use messaging to:
- Send unsolicited marketing or promotional content
- Send the same or substantially similar message to a large number of recipients
- Send chain letters, pyramid schemes, or any other unsolicited bulk content
- Share contact information or links for the purpose of moving conversations off-platform in order to evade fees, oversight, or these Terms
8. Security research
Responsible security research is welcomed. If you discover a vulnerability, please disclose it responsibly:
- Email a detailed report to legal@prebookmt.com with the subject line
SECURITY: <short summary> - Do not access more data than is necessary to demonstrate the vulnerability
- Do not publish details of the vulnerability before we have had a reasonable opportunity to fix it
- Do not use the vulnerability to access accounts that are not your own
Acting in good faith and within this paragraph, we will not pursue legal action against you for the research.
9. Reporting violations
If you encounter content or behaviour that violates this AUP — or anything you believe is illegal content under EU or Maltese law — you have two equivalent reporting channels:
- In-app — tap the "Report" button on the listing, review, message, or profile
- By email — send details to legal@prebookmt.com, with the subject line
REPORT: <short description>
A useful report includes: a description of the content or conduct, where on the platform it appears (URL or screen name), why you believe it is illegal or in breach of this AUP, your contact email (so we can follow up), and a statement that you act in good faith.
We acknowledge every report and aim to make a first decision within 5 business days. Reports made in bad faith (knowingly false) are themselves a breach of this AUP and may be acted on under Section 10.
Statement of reasons (Digital Services Act, Regulation (EU) 2022/2065). Where we remove, restrict, demote, or disable access to user-provided content — or suspend or terminate an account because of user content — we will provide the affected user with a written statement of reasons explaining what we did, why, and what avenues they have to challenge the decision. The statement of reasons is sent to the email address on the account.
Single point of contact. Users, recipients of services, and competent national authorities may contact PreBookmt about illegal content or DSA matters via legal@prebookmt.com, in English, Maltese, or any other official EU language (we will use translation where needed). PreBookmt is a sole-trader micro-enterprise within the meaning of the DSA and is therefore exempt from the Article 19–25 obligations for "very large online platforms" and from the heavier Section 3 platform duties; the hosting-level duties in Articles 14, 16, and 17 apply and are reflected in this AUP.
10. Enforcement
We may take any of the following actions, with or without prior notice, depending on the severity and frequency of the violation:

We retain absolute discretion to decide which action is appropriate in any given case.
11. Appeals
If your account is suspended or terminated and you believe the action was unjustified, you may appeal by emailing legal@prebookmt.com within 30 days of the action. Include:
- Your registered email address
- The reason you believe the action was unjustified
- Any supporting evidence
We will review the appeal and respond within 14 business days with a written outcome and the reasons for it. The decision on appeal is final within the PreBookmt platform; this does not affect your right to pursue any statutory or judicial remedy available to you under Maltese or EU law.
12. Changes to this AUP
We may update this AUP. Material changes will be notified by email and in-app banner at least 30 days before they take effect, except where an immediate change is required to address a security or legal issue.
